非訟事件法－第6條
有下列各款情形之一者，直接上級法院應依關係人之聲請或法院之請求，指定管轄：
一、有管轄權之法院，因法律或事實不能行使職權者。
二、因管轄區域境界不明，致不能辨別有管轄權之法院者。
三、數法院於管轄權有爭議者。
直接上級法院不能行使職權者，管轄之指定，由再上級法院為之。
指定管轄之裁定，不得聲明不服。
