民事訴訟法－第528條
關於假扣押聲請之裁定，得為抗告。
抗告法院為裁定前，應使債權人及債務人有陳述意見之機會。
抗告法院認抗告有理由者，應自為裁定。
准許假扣押之裁定，如經抗告者，在駁回假扣押聲請裁定確定前，已實施之假扣押執行程序，不受影響。
